Vagheggi Kft. is a legally registered business entity in Hungary since February 18, 2013. The company primarily engages in the wholesale and retail trade of perfumes, retail trade of miscellaneous industrial goods, wholesale distribution of various products, including cosmetics, provision of other educational services ("Beauty Academy"), provision of personal services, beauty training courses, as well as mail order and online retail activities.

 

1.2. Website: the website available at theacademy.hu, maintained and operated by Vagheggi Kft.

 

1.3. Beauty Academy: the online platform operated by Vagheggi Kft. on the Website for recording and fulfilling online orders for events and training sessions.

 

1.4. Users: readers, visitors, and users of the Websites, including any natural or legal person or other entity who visits, views, registers on the Website, subscribes to newsletters, or participates in any contests or promotions advertised by Vagheggi Kft. on the Website or elsewhere ("Usage").

 

1.5. Customers: customers, buyers, resellers, and business partners who have a contractual relationship with Vagheggi Kft. based on sales contracts or any other contracts ("Agreements") for products, training, or events, whether in the Shop or at the Beauty Academy.

 

1.6. Privacy Policy: this privacy policy and its current and valid versions;

 

1.7. Personal data: data relating to a natural person that can be associated with the User or Customer, including but not limited to their full name, identification data such as personal identification number, mother's name, place and date of birth, permanent address, delivery address, email address, telephone number, other electronic contact information, and any conclusions drawn from such data that pertain to the individual;

 

1.8. Other data: data relating to legal entities and other non-natural persons that can be associated with the User or Customer, including but not limited to company name or other designations, company registration number, tax identification number or other identification data, registered office address, delivery address, contact person's details, email address, telephone number, other electronic contact information, and any conclusions drawn from such data that pertain to the individual;

 

1.9. Data: the collective term for Personal data and Other data;

 

1.10. Public interest data: data not falling within the definition of Personal data or Other data that is in the possession of a public authority or person performing a public task defined by law;

 

1.11. Special data: any data that does not fall under the categories of Personal data, Other data, or Public interest data;

 

1.12. Data processing: any operation or set of operations performed on Data, whether or not by automated means, including collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure, or destruction of Data, as well as prevention of further use of Data;

 

1.13. Data Controller: a natural or legal person or an organization without legal personality that determines the purposes and means of Data processing, makes decisions regarding Data processing, and carries out such processing;

 

1.14. Data processing: the performance of technical tasks related to data processing, irrespective of the methods and tools used for such tasks, and the place of their implementation;

 

1.15. Data Processor: a natural or legal person or an organization without legal personality that processes Personal data on behalf of the Data Controller;

 

1.16. Data erasure: rendering Data unrecognizable in such a way that their restoration is no longer possible;

 

1.17. Data transmission: making Data accessible to a designated third party;

 

1.18. Consent: the voluntary and informed expression of the will of the User or Customer, based on appropriate information, by which they unambiguously consent to the processing of Data in its entirety or certain operations. Appropriate information includes the publication of this Privacy Policy on the Website and the notification of modifications to the Privacy Policy as described in section 2.4 of this Privacy Policy;

 

1.19. NAIH Decision: Decision No. NAIH-87207/2015 by the National Authority for Data Protection and Freedom of Information (NAIH), in which Vagheggi Kft. is registered as a Data Controller;

 

1.20. Newsletter: informational material electronically sent to Users and Customers by Vagheggi Kft. at regular intervals, providing information about the services, training sessions, events, promotions, etc.;

 

1.21. Direct Mail: informational material sent by post to Users and Customers by Vagheggi Kft. at regular intervals, providing information about the services, training sessions, events, promotions, etc. The rules applicable to the Newsletter shall also apply to Direct Mail.

 

2. THE SCOPE OF THE PRIVACY POLICY, ACCEPTANCE OF PRIVACY POLICY PROVISIONS

 

2.1 This Privacy Policy contains rules for the processing, use, and storage (“Data Processing”) of Users' and Customers' Data.

 

2.2 In order to respect the fundamental constitutional right to the protection of data, the purpose of this Privacy Policy is to establish principles and rules for Data Processing. This Privacy Policy comes into effect on the day of its enforcement. The enforcement date is the date of publication of this Privacy Policy on the Website, namely the 31st of July 2019. The provisions of the Privacy Policy apply to all Users and Customers from the date of enforcement.

 

2.3 Vagheggi Kft. reserves the right to modify the Privacy Policy. Vagheggi Kft. ensures that the current Privacy Policy is continuously accessible on the Website. The Privacy Policy must always contain the date of enforcement. All Users and Customers acknowledge that the provisions of the Privacy Policy applicable to Data Processing are those in force on the day of Data Processing. In the event of modification of the Privacy Policy, Vagheggi Kft. is obliged to indicate the modifications visibly in the text of the Privacy Policy and indicate the date of enforcement of these modifications.

 

2.4 Users, by using the Website, and Customers, by entering into a specific Contract, acknowledge and expressly accept the provisions of this Privacy Policy, even without explicit written acknowledgement, and declare that they have read, understood, and accepted the rules of the Privacy Policy.

 

3. PRINCIPLES OF DATA PROCESSING

 

3.1 Security of Data Processing: Vagheggi Kft. handles the Data confidentially and respects the Users' and Customers' right to information self-determination. Vagheggi Kft. takes the necessary technical and organizational measures and establishes procedural rules in this Privacy Policy to ensure compliance with the relevant laws. Data Processing is only carried out by the owners, executive officers, and employees of Vagheggi Kft. or, in the case of separate contractual arrangements, by their authorized representatives or subcontractors. In the latter two cases, the party contracting with Vagheggi Kft. is obliged to comply with the provisions of this Privacy Policy, and any violation of these provisions may result in legal consequences. Vagheggi Kft. does not use Data Processors during Data Processing.

 

3.2 Legal Basis for Data Processing: Data Processing is carried out only with the voluntary consent of the User or Customer or when mandatory data provision is required by law(s). Vagheggi Kft. only processes Data provided voluntarily by the User or Customer. Except for cases where it is necessary to provide data to authorities or other state bodies, Vagheggi Kft. only discloses Data to third parties with the prior consent of the User or Customer. Before fulfilling individual data requests from authorities, Vagheggi Kft. examines whether there is a legal basis and obligation for data disclosure and whether the data request is legally justified regarding all requested data.

 

3.3 Limitation on Purpose of Data Processing: Data can only be processed for a specific purpose and to exercise rights and fulfill obligations under the law. Each data processing event must comply with this purpose. Only Data that is essential for the realization of the purpose of Data Processing, suitable for achieving the purpose, and only to the extent and duration necessary for the purpose, can be processed. Vagheggi Kft. collects Data from Users and Customers that are indispensable for the realization of the purpose of Data Processing.

 

3.4 Purpose of Data Processing: The purpose of Data Processing is for Vagheggi Kft. to exercise its rights and fulfill its obligations based on laws or any contracts towards Users and Customers, identify Users and Customers, differentiate between them, use User and Customer data for statistical purposes and advertising activities, send promotional messages to Users and Customers, and monitor the quality of services provided to Users and Customers by Vagheggi Kft.

 

3.5 Data Storage: Vagheggi Kft. takes all necessary technical and organizational measures for secure data storage, preventing unauthorized access, unauthorized use, disclosure, alteration, or deletion, except when mandatory data provision to authorities or other state bodies is required.

 

3.6 Notification of Users and Customers: Upon request, Vagheggi Kft. provides information to Users and Customers via email regarding the purpose, legal basis, duration, and activities related to the processing of their Data, as well as the legal basis and recipients of possible Data transfers. Users and Customers acknowledge that Vagheggi Kft. is not obliged and not entitled to disclose User or Customer Data to third parties who are not Users or Customers, except for cases of data disclosure to government authorities.

 

3.7 Free Data Processing: All Users and Customers acknowledge that Vagheggi Kft. is entitled to process their freely accessible Data, i.e., publicly available Data in government or other databases, without the User's consent.

 

3.8 Processing of Special Categories of Data: Vagheggi Kft. does not request or process special categories of data from Users or Customers.

 

3.8 Protection of Your Personal Data: The protection of your personal data is of particular importance to Vagheggi Kft. and its partners. The collection and processing of personal data that can be used for identification during the use of our website comply with the applicable Hungarian data protection regulations (Act CXII of 2011). We treat your data confidentially and do not disclose them to third parties, except when necessary for the performance of the contract (e.g., postal services, courier services). Our employees, partners, and service providers are bound by confidentiality obligations towards us.

 

4. DATA PROCESSING

 

4.1 The Vagheggi Ltd. does not collect any data from Users and Customers that they do not voluntarily provide. However, in order to better serve the needs of Users and Customers, the Vagheggi Ltd. may place a small data package, known as a cookie, on the User's or Customer's computer. The User or Customer can delete the cookie from their computer or configure their browser to disable the use of cookies.

 

4.2 Users acknowledge that certain content, features, and competitions on the Website are accessible only to registered Users. During registration, Users are required to provide the following data: place of use (country, city, district), Personal data or Other data, and their specific scope. By registering on the Website, Users automatically give their consent to the Vagheggi Ltd. as the Data Controller. Registration is only possible by providing the mandatory data, and therefore, Users acknowledge that failure to provide all mandatory data will result in unsuccessful registration.

 

4.3 Customers acknowledge and accept that before or during the conclusion of any Contract, they are required to provide the Personal data or Other data and their specific scope as determined by the Vagheggi Ltd. Customers acknowledge that if a Contract fails to materialize for any reason, the Vagheggi Ltd. is authorized to use the provided Personal and/or Other data for marketing and statistical purposes.

 

4.4 In the case of User registration, Users can modify or delete their data at any time in the "My Profile" section under the Login menu. The data will be processed until the registration is deleted; however, Users acknowledge that the Vagheggi Ltd. may continue to use their data solely for its own statistical and marketing purposes.

 

4.5 Users have the option to subscribe to newsletters. Users give their consent to data processing by subscribing to the newsletter. During the subscription, Users provide the Personal data or Other data and their specific scope. Users can modify the provided data or permanently unsubscribe from the newsletter by clicking the "Unsubscribe from the newsletter" button. The data will be processed until the unsubscribe request; however, Users acknowledge that the Vagheggi Ltd. may continue to use their data solely for its own statistical and marketing purposes.

 

4.6 Users and Customers can request information about the processing of their data, request correction of their data, and request deletion of their data, except for data processing required by law. Upon request, the Vagheggi Ltd. will provide information to Users and Customers within 10 working days regarding the user- and customer-related data it processes, the purpose of data processing, the legal basis, and the duration.

 

4.7 The Vagheggi Ltd. deletes the data if the data processing is potentially unlawful, or if deletion is explicitly requested by the User or Customer, or if the purpose of data processing has ceased.

 

5. LEGAL REFERENCE

 

5.1 This Privacy Policy is prepared in accordance with the applicable Hungarian laws, particularly the Act CXII of 2011 on Informational Self-Determination and Freedom of Information ("Data Protection Act"), Act CXIX of 1995 on the Handling of Name and Address Data for the Purposes of Research and Direct Marketing, the Act VI of 1998 on the Ratification of the Convention for the Protection of Individuals with Regard to Automatic Processing of Personal Data, adopted in Strasbourg on January 28, 1981, the Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services, the Act XLVIII of 2008 on the Basic Conditions and Certain Restrictions of Economic Advertising Activities, and the Act V of 2013 on the Civil Code ("Ptk."), and other Hungarian laws in effect on the date of Use or Contract, as applicable. For matters not regulated in this Privacy Policy, the provisions of the Laws and other Hungarian laws in effect on the date of Use or Contract shall prevail.

 

6. MISCELLANEOUS PROVISIONS

 

6.1 The interpretation of this Privacy Policy shall be governed by Hungarian law.

6.2 The possible invalidity of any provision of this Privacy Policy shall not affect the validity of the remaining provisions.

6.4 Any legal dispute arising between the User or the Customer and Vagheggi Kft. regarding data processing or the provisions contained in this Privacy Policy shall be under the exclusive jurisdiction of the Budapest Central District Court or the Székesfehérvár Court.

The purpose of this information (hereinafter referred to as the "Information on the Processing of Personal Data") is to inform our service users and/or customers (hereinafter referred to as "users") about the procedures related to the collection, use, and dissemination of information that users provide to us through this website, desktop applications, and laptops (referred to as "Platforms"), and/or during data collection processes carried out during the provision of services and products requested by customers.

Vagheggi Kft. cannot provide the services offered on our Platforms if the requested information is not provided, and as a result, the user will not be able to register their own user account on our Platforms or request participation in programs and trainings;

Description of visits to our Platforms and the sources accessed;

Responses to any surveys or questionnaires, such as reviews of events and trainings. We use this information for analysis and better understanding of our users;

Information regarding the position when consent is given for the collection and processing of the referenced data; passport, driver's license, ID card, and other similar documents to which the user has consented to provide.

 

2.2. Automatically collected data

2.2.1. If the user registers through social media authentication procedures, Vagheggi Kft. can access specific personal data (such as last name, first name, photograph, email, number of Facebook friends, etc.) in the user's social media account, based on the terms of use applicable on these social media platforms. Additionally, we may collect certain Personal Data of the user when communicating with third parties through social media, for example, by clicking the "Like" button.

2.2.2. Regarding each visit made to our Platforms, and in accordance with applicable laws and with the user's consent, we may collect data related to the devices used and the network accessed when using our services. This includes information such as IP address, login details, type and version of the browser, type and version of browser plugins, operating system and platform, advertising identifiers, visit information (such as URL "clickstream" to and from our Platforms), displayed or searched products, download errors, duration of visits on specific pages, interactions on the pages, and any phone numbers dialed from our BackOffice. We collect this information using various technologies, including cookies (for more information, please read our Cookie Policy).

2.3.1. With the exception of the Personal Data categories described in section 2.3.2, we retain Personal Data for the duration of our relationship with the user and in accordance with applicable data retention laws.

3.2. We send service-related information via email and/or text messages and/or any other communication means if the processing of data is necessary for the performance of mutually agreed contractual obligations and/or the processing of data is based on the User's consent.

3.3. We allow access to our services and ensure that the User can communicate with the staff of Vagheggi Kft. if (i) the processing of data is necessary for the performance of mutually agreed contractual obligations, (ii) the processing of data is based on the User's consent, and/or (iii) it is necessary for the establishment, exercise, or defense of legal rights as required by law.

3.4. We ensure compliance with applicable laws, our Terms and Conditions, and the Privacy Policy. This data processing is necessary (i) for the performance of mutually agreed contractual obligations and/or (ii) to ensure compliance with legal rights as required by law.

3.5. In accordance with applicable laws and with the User's consent, we send marketing materials and necessary information to facilitate the provision of requested services, recommendations and instructions regarding our products and services that may be of interest to the User. Furthermore, we use the data to target our advertisements on social media platforms. This data processing is based on the User's consent and/or our legitimate interests (i.e., sending targeted advertisements to the User).

3.6. We inform the User about any possible changes in our services. This data processing is necessary (i) for the performance of mutually agreed contractual obligations and/or (ii) to ensure compliance with legal rights as required by law.

3.7. We enable users to participate in interactive features of our services, if they choose to do so. This data processing is necessary (i) for the performance of mutually agreed contractual obligations and/or (ii) the processing of data is based on the User's consent.

3.8. We maintain the security of our Platforms. This data processing is based on our legitimate interests (ensuring the security of our Platforms), is necessary to ensure compliance with legal rights as required by law, and/or is required to fulfill our legal obligations.

3.9. We comply with our legal obligations as required by law.

 

4. Who are the recipients of the information collected from the User, and for what purposes is the information transmitted?

7. Will the User's data be transferred? How and where?

The User's Personal Data will be used within the European Union ("EU") and will not be transferred to countries outside the EU.

 

8. What rights does the User have regarding their personal data?

8.1. If permitted by law, the User has the right to obtain a copy of their Personal Data held by us and request confirmation of whether their Personal Data is being processed, in which case they are entitled to access the data under Article 15 of the GDPR. The User may also terminate their own online account at any time and has the right to refuse consent for the processing of their own Personal Data.

In some cases, we may retain some information about the User if required by law or for other lawful purposes. For example, if we believe that the User has committed fraud or violated our Terms of Use, we may retain some information to prevent circumvention of applicable laws on our Platforms.

8.3. If the User believes that their rights have been violated, they have the right to lodge a complaint with the competent data protection authority or seek legal remedies for the infringement.
